Minor Guardianship and Conservatorship proceedings are initiated when a minor needs a suitable adult to act on their behalf. It is not a legal adoption. Instead, it provides the legal guardian with various legal powers to act as the minor child’s guardian. The legal guardian assumes responsibilities of a legal parent such as making decisions for the child’s welfare. The legal guardian has duties to fulfill annually in managing the child’s affairs. In some cases, a minor needs a legal guardian because the parents’ rights have been suspended, terminated, or the parent(s) have died leaving the minor child without a guardian. In other cases, a conservator is needed when a minor child awarded a significant amount of funds through a settlement. It’s important to preserve the minor child’s interest in the proceeds.
